第一章 总 则
第一条 汽车零担货运站(以下简称零担站),是经营汽车零担货物运输的服务单位和零担货物的集散场所,担负着组织零担运输生产、为货主服务、班线管理及信息传输等方面的任务。为了加强对零担站的科学管理,不断提高运输效率和服务质量,促进汽车零担货物运输事业的发展,根据中华人民共和国交通部《汽车零担货物运输管理办法》,特制定本办法。
第二条 零担站必须认真贯彻国家的有关政策、法令;严格执行各项规章制度;加强职业道德教育,不断提高职工的政治素质和业务能力;坚持安全优质,文明服务的方针,最大限度地满足用户的需要。
第三条 各级零担站(含代理点)必须遵守本办法。

第二章 零担站的设置、设施、人员及班组管理
第四条 零担站的分级及设置
根据零担货物吞吐量及当地经济发展状况,零担站分为一、二、三级。业务量极少的地方可设立代理点。较大城市可设中心站和若干分站。零担站的设置与撤销按《汽车零担货物运输管理办法》第三章规定办理。
第五条 零担站的设施
一、一、二级站
1.营业室(一级站应分别设立托运、提货营业)室。室内应设置营运线路图,营运班期表,里程运价表,营运站点分布图,托运须知、禁、限运货物通告,日历牌、公告板、留言处、意见簿、时钟、公用电话及书桌等。
2.货主休息室(兼业务洽谈室)。室内应设置桌椅和茶具。
3.仓库。应设置可靠的防雨、通风、消防、防窃、防鼠设施及方便装卸货物的高站台,配备适用的计量器具。
4.配备必要的装卸机具和小型取送货车辆。
二、三级站
1.营业室。室内应设置营运线路图,营运班期表,里程运价表,托运须知,禁、限运货物通告及方便货主办理托运手续的书写工具。
2.仓库。应设置可靠的防雨、防火、防窃、防鼠设施,配备必要的计量器具。
第六条 业务人员配备
零担站业务人员按零担货物吞吐量配备。月均吞吐量三十吨配备一人;三十吨以上一百吨以下配备二人;一百吨以上每增加一百吨增配一人;一千五百吨以上每增加二百吨增配一人(管理人员除外)。
第七条 班组管理
1.零担站站务人员可根据站务作业内容和作业量,分成若干班组。
2.班组工作是站务工作的基础,应选派政治素质较好,熟悉管理业务,具有良好职业道德,工作认真,勇于负责的人担任班组长。班组长向站长负责,保证完成分管的工作任务。
3.班组要指派专人搞好各项考核和原始记录,为改善企业经营管理提供资料。

第三章 运行组织、仓库及装卸管理
第八条 货源调查
一、零担站必须做好货源调查工作,掌握货物的流量、流向、流时,为合理开辟班线,布设网点,调整班次和班期提供依据。
二、货源调查宜采取下列三种方法:
1.经常性调查:利用日常受理业务,定期对运单进行分析,召开货主座谈会,收集货主意见,积累调查资料,摸清货流规律;
2.重点调查:对本地区内的重点货主单位进行定期走访,了解货主对零担货运的要求,根据货主需要,及时调整或开辟新的班线;
3.地区性调查:对本地区内工矿企业生产和商品流通等有关情况进行综合性调查,探索和掌握本地区零担运输发展的规律和趋势。
第九条 班线开辟
一、零担运输班线的开辟应本着少中转、多直达,避免迂回运输,保证货物及时运送为原则,既要方便货主,把社会效益放在首位,又要有利于提高企业经济效益。既要顾及眼前,又要考虑长远需要。
二、班期的确定:应满足货主对零担货运的时间要求。起运站和终到站双方应根据需要,合理确定班期,班期间隔时间最长不超过七天。
三、班线开辟、停运、变更的审批程序和权限,按《汽车零担货物运输管理办法》第四章规定办理。
第十条 运行组织
一、零担站应定期编制班车运行作业计划,及时向车属方提供班期内货物流量、流向资料,确保班车正常运行。行。
二、站长要加强现场管理,及时排除影响正班作业障碍,保证作业计划实施。
三、货源临时发生变化,需变更原班期或班车车型时,站方应及时修改作业计划,并按协议规定通知车属方和有关站。
四、由于自然灾害或道路受阻,影响班车正常运行或需绕道运行时,站方应及时通告有关各方,并向当地交通主管部门报告。
五、班车运行中发生故障或发生事故,就近站应积极组织救援。
第十一条 库、场管理
一、一、二级站应按货物的发运、中转、到达分别设立仓库和货场;三级站可根据库、场条件划分发运、中转、到达专用货区。分设仓库按线路划分货位。货区、货位标志清楚。
二、仓库理货员对受理入库货物要认真核对整理,按货物的流向、受理顺序、发运时间和到达地点,合理堆码,标签朝外。
三、仓库要建立健全货物保管和清仓查库制度。理货员对出入库货物必须及时登入台帐,并坚持定期盘查,保证单、货相符,发现问题及时处理。
四、仓库要建立健全保卫制度。严禁烟火。露天堆放货物要有防雨、防潮、防盗设施。库内禁止托运人、提货人及其他无关人员进入。
第十二条 装卸管理
一、货物装卸由仓库理货员同随车理货员按交接清单逐件核对装卸,双方确认无误后在交接清单上签章。
二、装卸货物应做到:远站先装、近站后装,重不压轻、大不压小,实不压虚,标志向外、箭头向上,轻搬轻放,文明装卸。
三、货物装卸作业中,发现包装破损,货物短缺,按《汽车零担货物运输管理办法》有关规定处理。

第四章 站务作业程序管理
第十三条 受理
一、受理人员要严格审核运单,认真检查货物包装,确辨货物真伪,并制发和货物件数相符的货物标签。货物标签和储运指示标志由托运人拴挂和粘贴。
二、收款人员按照受理后的运单计费收款、开票,做到票面整洁、字迹清楚、端正、计费准确,应收不漏,印戳清晰无遗。
第十四条 理货
一、理货员按运单对货物的品名、件数、包装、货物标签及到站和运输号码进行认真核对,确认票货相符,签章验收并登入台帐。
二、货物验收入库后,理货员应按货物流向、货物种类,指导装卸人员放至指定货位,并按本办法第十一条“仓库管理”的要求堆码存放。
三、装车理货按本办法第十二条“装卸管理”规定办理,做到轻重搭配,合理装载。发现破损,未作处理不得发运。
四、运行中的理货工作由随车理货员(驾驶员)负责。沿途装卸货物,应与站方理货员做好交接。
第十五条 交接
一、货物交接必须严格履行交接手续。做到按票点交,件交件收,一票交清,票货相符,签章生效。
二、填写“汽车零担货物交接清单”时(附表一),各项栏目必须逐项填写清楚,相同项目不得用省略号代替,实行一站一单,避免差错。
三、货物交接过程中,遇有票货不符,越站错运、包装破损、货物短缺等情况时,按《汽车零担货物运输管理办法》第九章第三十二条规定办理。
第十六条 中转
一、凡中转货物,起运站必须向中转站单列交接清单。中转站应严格履行交接手续,并坚持优先发运,一票货物不得分运的原则,中转期限最长不得超过两个班期。
二、中转站对中转货物应注意流向是否合理。对流向不合理,但可以中转的货物,仍应中转,同时通知起运站予以改善。
三、发现中转货物包装破损,按《汽车零担货物运输管理办法》第十章规定办理。
第十七条 交付
一、交付货物应按《汽车零担货物运输管理办法》第十一章规定办理。
二、凡送货上门交付的货物,送货车必须配有随车理货员。随车理货员应分别向仓库理货员和收货人严格履行交接和交付手续。

第五章 票据和营收管理
第十八条 票据管理
零担站使用统一的票据,并设立专人管理。票据管理人员定期向票据主管部门请领和向分支机构分发票据。票据的请领、发放必须建立严格手续,对错号缺页的票据应停止使用,并交有关部门处理。
第十九条 票据审核
票据应建立定期审核制度。审核内容包括:各种票据请领、使用和分发、结存是否相符;票号是否衔接;票据、报解,实收金额是否一致;以及有无错收和漏收等。
第二十条 营业收入管理
一、营业收入必须做到日清、日结、日缴,现金当日存入银行。营业收入较少的三级站要做到日清、月结,现金及时存入银行。
二、搞好营业收入归库,严格营收审核,防止漏收、漏报。营业收入款不准挪用坐支。

第六章 质量管理
第二十一条 组织领导
各级零担站要加强运输服务质量管理,成立质量管理领导小组,并按作业量配备专职或兼职质量检验人员。
第二十二条 质量责任制
零担站的各作业岗位都应制定严格的质量岗位责任制,确定质量目标,明确质量责任。
第二十三条 质量检查
零担站质量检验员负责各作业岗位日常的质量检查工作。质量管理领导小组负责全站的质量管理工作,并经常走访货主,听取意见,定期开展质量大检查,杜绝质量事故,确保安全优质。

第七章 资料、站容管理
第二十四条 资料管理
一、对具有合同性质、明确交接责任的资料以及结算单证,必须妥善保管。
二、资料管理应有专人负责,做到认真收集,严格审核、分类装订,列册登帐,归档保管。
三、归档的一般资料保存二年;货票提货联和货主的提货证明保存三年;财务凭证保存期限按财务部门的规定执行。
第二十五条 站容管理
一、站容。室内整洁卫生,各项服务标志完整醒目。室外场地平整,四周环境整洁。
二、库容。库房清洁无尘,地面平整,货位分布合理,货物堆码整齐有序。
三、仪容。工作人员衣帽整洁,佩戴服务证(牌)举止端庄大方。

第八章 商务查询及事故处理
第二十六条 商务查询
一、查询范围
1.票货分离:有票无货或有货无票;
2.票货不符:票列货物的品名、包装、件数、重量等与货物不符;
3.到站或中转错误:包括误装、误卸、串件、越站等;
4.堵留滞运及其它:包括货物超期压库、中转滞运、逾期不到等。
二、查询程序
1.商务查询首先由差错发现站据实填写“汽车零担货物运输商务差错查询单”(附表二),挂号邮寄或用电话通知被查询站。
2.被查询站根据查询内容,对每一作业过程,交接手续,台帐记录进行认真核查,并将结果填入查询单挂号邮寄或用电话答复查询站;
3.查询单填写要准确、详细;查询电话记录要清楚,并相互通报通话人姓名。
三、查询期限
一般自被查询站接到查询单(或电话)之日(以邮局投递日戳或电话记录为准)起,至发回查询结果(或电话)之日止(以邮局发寄日戳或电话记录为准),不得超过十天;重大或中转环节较多的查询,最多不得超过二十天。
四、中转查询
按货物的中转程序依次进行。
五、派员查询
被查询站应积极协助工作,并提供方便,不得借故刁难或扣押货物。
第二十七条 事故处理
一、事故分类按交通部《汽车货物运输质量管理办法》(试行)第九章第三十二条规定办理。
二、事故处理按交通部《汽车零担货物运输管理办法》第十二章规定办理。

第九章 考核、评比和奖惩
第二十八条 考核
各级零担站都应根据作业量设立专职或兼职考核员,依据作业记录和质量检验员质量检查结果,对班组和个人做好日常考核工作。对有明确作业指标的岗位,定期核定其指标完成情况,为开展评比积累资料。
第二十九条 评比
零担站对班组和个人应坚持季评比、年总评;主管部门对零担站实行半年初评、年度总评。通过评比,总结经验,改进工作,表彰先进。
第三十条 奖惩
根据企业奖励基金提取的有关规定,确定奖金提取额,并将奖金的发放和职工业绩挂勾,贯彻按劳分配,奖勤罚懒、赏罚分明的原则,不断提高站务工作质量。

第十章 附 则
第三十一条 本办法由中华人民共和国交通部负责解释。
第三十二条 本办法自一九八八年二月一日起执行。
第三十三条 各省、自治区、直辖市可依据本办法制定实施细则,并报部备案。
附录一 汽车零担货物交接清单使用说明
一、式样:见附表一。
二、印制规格:汽车零担货物交接清单为薄纸复写式,用28克彩色打字纸印制,每组一式六联,每联号码前按照顺序加印(1)(2)(3)(4)(5)(6)编码。其中:第一联白纸黑线黑字,在下方框外加印(1)存根(起运站存查);第二联淡绿纸黑线黑字,在下方框外加印(2)报核(起运站运费、中转费、杂费结算核对依据);第三联淡红纸黑线黑字,在下方框外加印(3)随车同行(车籍单位凭以制作运费结算汇总单);第四联淡橙纸黑线黑字,在下方框外加印(4)随车同行(车属单位车队统计凭证);第五联兰纸黑线黑字,在下方框外加印(5)随车同行(到达站凭以制作站务费用结算汇总单;第六联淡黄纸黑线黑字,在下方框外加印(6)随车同行(到达站存查)。
表式尺寸:长×宽24cm×18cm
每五十组为一本,上面胶边装定。
三、使用方法:
汽车零担货物交接清单,是汽车运输企业内部零担货物交接的重要依据,发运前由仓库理货员或发货员制单,按照一站一单,不同到达站不得合用一单的要求,分别逐项填写清楚。
第一联起运站存查:第二联报核,起运站财务结算核对依据;第三联随车同行,到达站签收后交随车理货员(驾驶员),作为车属单位制作结算汇总单的依据,第四联随车同行,到达站签收后交驾驶员,随行车路单作为车队统计的依据;第五联随车同行,到达站签收后凭以制作站务费
用结算汇总单,并报公司运务统一结算;第六联到达站存查。附表一:

汽车零担货物运输商务差错查询单一式三联。统一加印顺序号。由00001--10000号。并以甲、乙、丙、丁循环号码前首字冠印经营单位简称。
表式尺寸:长x宽:24cm×18cm。
印制规格:用40克白色书写纸印制。三联均用黑线黑字。右侧框外分别加印第一联:查询站存查。第二联:查询答复。第三联:被查询站存查。
每五十组为一本,上边胶边装定。
使用方法:遇有货物查错,由发现站发出查询,第一联由查询站存查,第二、三联寄被查询站。被查询站按查询内容查询后,及时把第二联将查询结果填写签章退回查询站,作为查询结果的依据。

国务院关于口岸开放的若干规定(附英文)

规定
随着我国对外贸易、国际交往和旅游事业的发展,将进一步开放新的口岸。为加强口岸开放的审批工作,特制定本规定。
一、本规定所指口岸是供人员、货物和交通工具出入国境的港口、机场、车站、通道等。口岸分为一类口岸和二类口岸。一类口岸是指由国务院批准开放的口岸(包括中央管理的口岸和由省、自治区、直辖市管理的部分口岸);二类口岸是指由省级人民政府批准开放并管理的口岸。
二、口岸的开放和关闭,由国务院或省级人民政府审批后公布执行。
三、凡开放口岸,应根据需要设立边防检查、海关、港务监督、卫生检疫、动植物检疫、商品检验等检查检验机构,以及国家规定的其他口岸机构。
四、两类口岸的具体划分:
(一)以下为一类口岸:
1、对外国籍船舶、飞机、车辆等交通工具开放的海、陆、空客货口岸;
2、只允许我国籍船舶、飞机、车辆出入国境的海、陆、空客货口岸;
3、允许外国籍船舶进出我国领海内的海面交货点。
(二)以下为二类口岸:
1、依靠其他口岸派人前往办理出入境检查检验手续的国轮外贸运输装卸点、起运点、交货点;
2、同毗邻国家地方政府之间进行边境小额贸易和人员往来的口岸;
3、只限边境居民通行的出入境口岸。
五、报批程序:
(一)一类口岸:由有关部(局)或港口、码头、车站、机场和通道所在地的省级人民政府会商大军区后,报请国务院批准,同时抄送国务院口岸领导小组、总参谋部和有关主管部门。
(二)二类口岸:由口岸所在地的人民政府征得当地大军区和海军的同意,并会商口岸检查检验等有关单位后,报请省级人民政府批准。批文同时送国务院口岸领导小组和有关主管部门备案。
六、报批开放口岸应附具下列资料:
(一)对口岸开放进行的可行性研究报告,以及口岸的基本条件、近三年客货运量、经济效益和发展前景的资料。
(二)根据客货运输任务提出的有关检查检验单位、口岸办公室、中国银行等机构设置和人员编制方案。
(三)检查检验场地和办公、生活设施等规划,以及投资预算和资金来源。
七、对外开放前的验收:
(一)新开放的口岸,在开放前必须对其交通安全设施、通信设施、联检场地、检查检验等单位的机构设置和人员配备,以及办公、生活设施等进行验收。验收合格后,才能宣布开放。
(二)一类口岸,由国务院口岸领导小组办公室负责组织验收;二类口岸,由所在省、自治区、直辖市口岸办公室或其他主管口岸工作的部门负责组织验收。
八、临时进出我国非开放区域的审批权限:
(一)临时从我国非开放的港口或沿海水域进出的中、外国籍船舶,由交通部审批,并报国务院口岸领导小组备案。报批前应征得军事主管部门和当地人民政府以及有关检查检验单位的同意,并安排好检查检验工作。
(二)临时从我国非开放机场起降的中、外国籍民用飞机,由中国民用航空局征得军事主管部门同意后审批,非民用飞机由军事主管部门审批,并报国务院口岸领导小组备案。报批前应征得当地人民政府和有关检查检验部门的同意,并安排好检查检验工作。
(三)临时从我国非开放的陆地边界区域进出境的中、外国籍车辆和人员,由省级人民政府审批。报批前应征得当地省军区和公安部门的同意,并安排好检查检验工作。
九、口岸开放应有计划地进行,按隶属关系分别列入国家或地方口岸开放计划。国务院有关部门和省、自治区、直辖市应将口岸开放计划(草案),于计划年度前两个月报国务院口岸领导小组,并抄报国家计委、劳动人事部和检查检验单位的有关主管部门。
十、开放口岸检查检验设施建设资金来源:
(一)中央管理的口岸,由中央负责解决;地方管理的口岸,由地方负责解决。
(二)国家新建开放的港口、码头、车站和机场(含军用改为军民合用的机场)等口岸建设项目(包括利用外资和中外合资项目),以及老口岸新建作业区和经济开发区的新港区等项目,所需联检场地应与港口、码头、车站、机场等主体工程统一规划。所需投资包括在主体工程之内。
检查检验单位办公、生活土建设施(包括宿舍)的投资,由口岸建设项目的主管部门组织有关单位研究,统一汇总报国家计委审批。批准后,投资划拨给口岸所在地的省、自治区、直辖市,由地方统一规划,统一设计施工。军用改建为军民合用机场的口岸项目,应事先征得空军或海军同意,如在机场内建设,建设单位可提出要求,由空军或海军统一规划。
(三)各部(局)直属的原有港口、码头、车站和机场需要对外开放时,所需联检场地,原则上要利用原有建筑设施。如确需扩建、新建,应由港口、码头、车站和机场的主管部门投资建设。检查检验单位的办公、生活土建设施(包括宿舍)的投资,原则上由各自主管部门解决。对确有困难的,国家或地方给予适当补助,由地方统一建设,投资交地方包干使用。
(四)地方新开口岸,所需联检场地和检查检验单位的办公、生活土建设施(包括宿舍),由地方统一投资,统一建设。
(五)国际海员俱乐部的建设规划和投资来源,比照(二)、(三)、(四)项规定解决。
(六)检查检验单位所需的交通工具、仪器设备等,由各自主管部门解决。
(七)联检场地内,划给检查检验单位的办公和业务用房(包括水、电、市内电话),应由港口、码头、车站和机场(包括军民合用的机场)的经营单位免费提供。
十一、本规定由国务院口岸领导小组办公室负责解释。
十二、本规定自发布之日起施行。

PROVISIONS OF THE STATE COUNCIL ON THE OPENING OF PORTS
(Promulgated on September 18, 1985)
With the development of our foreign trade, international exchanges and
tourisms, more ports will be opened. These Provisions are formulated in
order to strengthen the work in the examination and approval for opening
ports to foreign countries.
1. The term "ports" referred to in these Provisions denotes the harbours,
airports, stations, thoroughfares, etc., which are used for personnel,
goods or means of transport to enter or leave the country. The ports in
our country are divided into two categories. Category-1 ports refer to
those ports which have been opened upon the approval of the State Council
(including those administered by the Central Government and some of the
ports administered by the provinces, autonomous regions and municipalities
directly under the Central Government); category-2 ports refer to those
ports which have been opened upon approval by the people's governments at
the provincial level and are administered by them.
2. The opening and closing of ports shall be announced and executed after
the examination and approval by the State Council or the people's
governments at the provincial level.
3. Organs in charge of frontier inspection, Customs, harbour
superintendency, quarantine, quarantine for animals and plants, commodity
inspection, etc., as well as other port organs stipulated by State shall
be set up at the open ports according to the actual needs.
4. Criteria for the division of the two categories of ports:
(1) The following are category-1 ports:
A. ports open to vessels, planes, vehicles and other means of transport of
foreign nationality used to transport passengers and goods into or out of
China through sea, land or air;
B. ports for use only by Chinese vessels, planes and vehicles transporting
passengers and goods out of or into the country through sea, land or air;
C. spots on the sea within our territorial waters where vessels of foreign
nationality are allowed to enter or leave for the purpose of delivering
goods.
(2) The following are category-2 ports:
A. spots for loading and unloading, starting shipment and delivering goods
for Chinese vessels engaged in foreign trade where the formalities for
exit and entry inspection and examination are conducted by personnel sent
from other ports;
B. ports where border trade in small amounts and contacts between people
are carried out with local governments of neighbouring countries;
C. ports restricted to the exit or entry of the local residents in the
border areas.
5. The procedures for report and approval:
(1) Category-1 ports: the relevant ministries (or bureaus) or the people's
governments of the provinces where the harbours, wharves, stations,
airports and thoroughfares in question are situated shall, after
consultation with the military area commands, submit the application to
the State Council for approval, with copies of the application sent to the
Leading Group for Port Affairs of the State Council, the Headquarters of
the General Staff of the People's Liberation Army and the relevant
competent departments.
(2) Category-2 ports: The people's governments of the regions where the
ports in question are situated shall first obtain the agreement of the
military area commands concerned and the Navy, and hold consultations with
the units in charge of port inspection and examination. Applications shall
then be submitted to the people's governments at the provisional level for
approval, with copies of which sent to the Leading Group for Port Affairs
under the State Council and the relevant competent departments for the
record.
6. The following materials should be attached to application for opening a
port:
(1) A feasibility report, the materials concerning the basic conditions of
the ports, the volume of passenger transport and freight volume in the
last three years, and the potential economic results and the prospects for
development.
(2) The plan for the establishment of such port organs as offices in
charge of inspection and examination, offices for port affairs and
branches of the Bank of China, according to the task for transporting
passengers and goods.
(3) Plans for constructing inspection and examination grounds and for
building facilities for office work and the daily life of the staff
members, as well as investment budget and source of funds.
7. Final check-up and acceptance before a port is opened:
(1) Before a new port is opened, the establishment of organs and the
provisions of staff members of offices in charge of traffic safety, for
telecommunications, combined inspection and examination as well as
facilities for office work and daily life must go through the procedure of
final check-up and acceptance. New ports may be opened only after the
facilities are finally checked and accepted.
(2) The office of the Leading Group for Port Affairs of the State Council
shall be responsible for the check-up and acceptance of category-1 ports.
The offices for port affairs in the provinces, autonomous regions and
municipalities directly under the Central Government or other competent
departments in charge of port affairs shall be responsible for the check-
up and acceptance of category-2 ports.
8. The competence for examination and approval of applications for
temporarily entry and exit at the non-open areas of our country:
(1) Applications by vessels of Chinese or foreign nationality for
temporarily entry or exit at non-open harbours or coastal waters of China
shall be examined and approved by the Ministry of Communications and
reported to the Leading Group for Port Affairs of the State Council for
the record. Before the applications are submitted for approval, the
agreement of the competent authorities for military affairs, the local
people's governments and the relevant units in charge of examination and
inspection shall be obtained, and the details of the examination and
inspection work shall be arranged.
(2) Applications by civil planes of Chinese or foreign nationality for
temporarily take-offs or landings at China's non-open airports shall be
examined and approved by the Civil Aviation Administration of China,
which, however, should obtain the agreement of the competent authorities
for military affairs. Applications by non-civil planes shall be examined
and approved by the competent authorities for military affairs. Both kinds
of applications must be reported to the Leading Group for Port Affairs of
the State Council for the record. Before the applications are submitted
for approval, the agreement of the local people's governments and the
relevant departments for examination and inspection should be obtained,
and the details of the examination and inspection work shall be arranged.
(3) Applications by vehicle and personnel of Chinese or foreign
nationality for temporarily entry and exit at our non-open border areas on
land shall be examined and approved by the people's governments at the
provincial level. Before the applications are submitted for approval, the
agreement of the relevant provincial military area command and the
department of public security shall be obtained, and the details of the
examination and inspection work shall be arranged.
9. New ports shall be opened according to the relevant State or local
plans. The competent departments under the State Council, and the
provinces, autonomous regions and municipalities directly under the
Central Government, shall send plans (drafts) of opening ports to the
Leading Group for Port Affairs of the State Council two months before a
planned year begins, with copies sent to the State Planning Commission,
the Ministry of Labour and Personnel and the relevant competent
departments of the units in charge of inspection and examination.
10. The sources of funds for building facilities for inspection and
examination at the open ports:
(1) The Central Government shall be responsible for providing the funds
for the ports under its administration. The local people's governments
shall be responsible for providing funds for the ports under their
administration.
(2) Where grounds for combined inspection and examinations are needed in
such port construction projects (including projects with foreign
investment and Chinese and foreign equity joint-venture projects) as
harbours, wharves, railway stations and airports (including those which
have been transformed from military airports used for both military and
civilian purposes) as well as in such projects as newly-built operation
areas at old ports and new harbour areas in economic development zones,
the construction of these grounds shall be incorporated into the plans of
the main projects of the prescribed harbours, wharves, railway stations
and airports. The investment needed for the construction of these grounds
shall be incorporated in the investment for the main projects. The
competent departments for port construction projects shall organize the
relevant units to carry out research on the investment structure for the
construction of the facilities for office work and for the daily life of
the staff members (including dormitories) of the units in charge of
inspection and examination and present itemized reports to the State
Planning Commission for examination and approval. After the approval is
obtained, the investment shall be transferred to the provinces, autonomous
regions and municipalities directly under the Central Government where the
ports are situated. The local people's governments shall be responsible
for the unified planning, designing and construction of the ports. Where
military airports are to be transformed into airports for both military
and civilian purposes, agreement should be obtained from the Air Force or
the Navy beforehand. In the case that the construction is to be carried
out within the airports, the units responsible for the construction may
submit draft plans, which shall be incorporated in the unified plans of
the Air Force or the Navy.
(3) Where the existing harbours, wharves, railway stations and airports
directly under the administration of various ministries (or bureaus) need
to be opened, the grounds for combined inspection and examination for
these ports shall, in principle, be set up by making use of the existing
buildings and facilities. If it is necessary to extend the original
buildings or build new grounds for combined inspection and examination,
the competent departments for the harbours, wharves, railway stations and
airports shall be responsible for the investment. The investment for the
construction of the facilities for office work and the daily life of the
staff members (including dormitories) of the units in charge of inspection
and examination shall, in principle, be provided by their respective
competent departments. In the extreme cases of difficulty with respect to
investment, the State or the local governments may provide appropriate
subsidies. The investment shall be turned over to the relevant people's
governments, which are held responsible for the completion of the
construction.
(4) The local people's governments shall be responsible for the investment
and construction of the grounds for combined inspection and examination
and the infrastructure facilities for office work and the daily life of
the staff members (including dormitories) of the units in charge of
inspection and examination, which are needed in their newly-opened ports.
(5) The construction plans and sources of investment for international
seamen's clubs shall be provided in accordance with the provisions of
Paragraphs (2), (3) and (4) of this Article.
(6) The means of transport, instruments, equipment, etc., needed by the
units in charge of inspection and examination shall be provided by their
respective competent departments.
(7) Within grounds for combined inspection and examination, the rooms for
office work and other related purposes (including water, electricity and
inner-city telephone) which have been assigned to the units in charge of
inspection and examination shall be provided free of charge by the
business units of the harbours, wharves, railway stations and airports
(including those used for both military and civilian purposes).
11. These Provisions shall be interpreted by the office of the Leading
Group for Port Affairs of the State Council.

第一条 在中华人民共和国港口行驶的外国籍船舶和外商租用的中国籍船舶,以及中外合营企业使用的中外国籍船舶(包括专在港内行驶的上项船舶),均按本办法由海关征收船舶吨税(以下简称吨税)。
前项应完吨税船舶,毋庸另向税务机关完纳车船使用牌照税。
第二条 吨税分三个月期缴纳与三十天期缴纳两种,由纳税人于申请完税时自行选报,其税级税率列明如下:
(一)按三个月期缴纳者:
(二)按三十天期缴纳者,照前表税率减半征收。
进口船舶应自申报进口之日起征,如所领吨税执照满期后尚未驶离中国,则应自原照满期之次日起续征。
第三条 应征吨税船舶的国籍,如属于同中华人民共和国签有条约或协定,规定对船舶的税费相互给予最惠国待遇的国家,该船舶的吨税按优惠税率计征。其按三个月期缴纳的吨税税率如下:
按本条规定纳税之船舶,如申请按照前条办法按三十天期缴纳,照上表减半征收。

(一)船舶国籍证书(或港务机关签发的收存此项证书之证明书);
(二)船舶吨位证明,向关申报完税。
第五条 前项船舶,其吨税执照之有效期间在申报进口后满期者,及专在港内行驶者,均应于原照满期时按前条规定向关申报纳税领照。倘自满期次日起五日内不向关申报完税,应按本办法第十四条规定论罚。

条规定在到达或驶离港口时向当地港务机关交验船舶吨税执照(无港务机关地方应向当地边防公安机关或部队交验),在原照满期时,并应按照本办法第四、五条规定报由当地税务局依本办法代征吨税发给执照,逾期不报按第十四条论罚。
第七条 纳税人应自海关(或税务局)签发吨税缴款书之次日起五日内(星期日及规定放假日除外)缴清税款,由关(或局)填发船舶吨税执照,逾期由关(或局)自第六天起至缴清税款之日止按日征收应纳税额千分之一的滞纳金,作为海关罚款入库。
第八条 外商租用的中国籍船舶,及中国公私营企业租用的外国籍船舶,在租用关系开始或解除时,其原纳车船使用牌照税或船舶吨税,如尚未满期,得仍继续有效。惟期满后应即按照当时使用关系向关报完吨税或向税务局报完车船使用牌照税。
第九条 船舶因经修理,原净吨位有所增减,在原领吨税执照有效期内,不再调整税额。惟于下期完纳吨税时应按吨位变更后的吨位证书,申请核定税额。如吨位增高而匿不申报,希图漏税者,按本办法第十四条规定处罚。
第十条 已完吨税之船舶,具有下列情形之一者,海关得验凭所交港务机关证明文件,按其实际日数,将执照有效日期,批注延长:
(一)船舶驶入我国港口避难、修理者;(二)船舶因防疫隔离不能上下客货者;
(三)船舶经中央或地方人民政府征用或租用者。
第十一条 下列各种外籍船舶,免征吨税:
(一)与我国建立外交关系国家之大使馆、公使馆、领事馆使用的船舶;
(二)有当地港务机关证明之避难、修理、停驶或拆毁的船舶,并不上下客货者;
(三)专供上下客货及存货之泊定趸船、浮桥趸船及浮船;
(四)中央或地方人民政府征用或租用的船舶;
(五)合于暂行海关法第二十七条规定毋庸向关申报进口的国际航行船舶。
第十二条 船舶使用人如于该船未到达港口以前办理结关手续者,须向关递送书面保证,担保俟船舶驶入港口后交验吨税执照,或遵章完纳吨税请领执照。此项执照的有效日期,亦应自船舶申报进口之日起算。
第十三条 船舶使用人所领吨税执照,在有效期间内,如有毁损或遗失时,得向原发执照海关(或税务局)书面声明,并请另发吨税执照副本,不再补税。
第十四条 不按本办法规定申报纳税领照者,除限期办理外,并处以应纳税额三倍以下之罚金,以海关罚款入库。
第十五条 本办法自发布之日施行。(附英文)

INTERIM MEASURES OF THE CUSTOMS OF THE PEOPLE'S REPUBLIC OF CHINA
CONCERNING VESSEL TONNAGE DUES
(Approved by the Financial and Economic Committee of the Govern-
ment Administration Council on September 16, 1952 and promulgated and put
into effect by the General Customs Administration on September 29, 1952)
Article 1
Vessel tonnage dues (hereinafter referred to as tonnage) shall be levied
by the Customs in accordance with these Measures on foreign registered
vessels and Chinese registered vessels chartered by foreign firms and
Chinese or foreign registered vessels used by Chinese-foreign equity joint
ventures (including vessels sailing exclusively within the ports) sailing
in the ports of the People's Republic of China. It is not necessary for
the said vessels paying tonnages to pay additional vehicle and vessel
service licence fees to the tax authorities.
Article 2
Tonnages are divided into two types: one to be paid once every three
months and the other to be paid once every 30 days, to be chosen by the
payers themselves when they apply for the payment of the tonnages. The
scale and rate of the tonnages are as follows:

2. Those to be paid once every 30 days shall be levied at half the rates
in the above list. The tonnage shall be levied on an incoming vessel from
the date of its declaration for entry. If the vessel does not leave China
at the expiration of the tonnage licence, the levy shall continue as of
the next day of the expiration.
Article 3
The tonnage for a vessel which is registered in or belongs to a foreign
country which has entered into a treaty or agreement with the People's
Republic of China for mutual preferential treatment of tonnages or fees
levied on vessels shall be levied at a preferential rate. The rates of
tonnages to be levied once every three months are as follows:

If a vessel paying the tonnage as stipulated under this Article applies to
make payment once every 30 days in accordance with the procedures in the
preceding Article, the tonnage shall be levied at half the rates in the
above list.
Article 4
A foreign registered vessel or a Chinese registered vessel chartered by a
foreign firm shall submit the vessel tonnage licence and the declaration
at the Customs for examination and entry or clearance purposes as
stipulated by the Customs when it arrives at or leaves a port where there
is a Customs establishment. If the original licence has expired at the
time of entry or the tonnage has not been paid before, it shall file a
declaration at the time of entry, make the declaration at the Customs and
pay the tonnage by submitting (1) the certificate of the vessel's registry
(or the testimonial signed and issued by the port authorities to testify
that this certificates has been kept in their custody) and (2) the
certification of the vessel's tonnage for examination.
Article 5
If the term of validity of the tonnage licence of the above vessel has
expired after its declaration for entry or if it sails exclusively within
the port, it shall make a declaration at the Customs, pay the tonnage and
obtain a new licence as stipulated in the preceding Article upon
expiration of the original licence. If it fails to make a declaration and
pay the tonnage within 5 days of expiration, it shall be fined according
to the stipulation in Article 14 of these Measures.
Article 6
A foreign registered vessel specially permitted to sail to or from a place
where there is no Customs establishment shall submit the vessel tonnage
licence to the local port authorities for examination (it shall be
submitted to the local frontier public security organs or frontier forces
for examination in a place without port authorities) as stipulated in
Article 4 of these Measures when it arrives at or leaves the port. At the
expiration of the original licence, it shall also make a declaration at
the local tax bureau as stipulated in Article 4 and Article 5 of these
Measures and the bureau shall collect the tonnage and issue a new licence
in lieu of the Customs according to these Measures. If it fails to make a
declaration within the time limit, it shall be fined in accordance with
Article 14.
Article 7
The payer shall pay the tonnage within 5 days (Sundays and statutory
holidays excepted) of the issue of the Notice of Tonnage Payment by the
Customs (or the tax bureau) and the Customs (or the bureau) shall issue
the vessel tonnage licence. If the time limit is exceeded, the Customs (or
the bureau) shall collect a fine for delaying payment of 0.1% of the
payable tonnage daily from the sixth day to the day of full payment of the
tonnage and pay it into the treasury as Customs' fines.
Article 8
In the case of a Chinese registered vessel chartered by a foreign firm or
a foreign registered vessel chartered by a Chinese public or private
enterprise, the vehicle and vessel service licence tax or the vessel
tonnage already paid shall remain valid if it has not expired at the
beginning or termination of the charter. However, the vessel shall make a
declaration at the Customs' and pay the tonnage or make the declaration at
the tax bureau and pay the vehicle and vessel service licence tax upon its
expiration on the basis of the charter at the time.
Article 9
The tonnage amount shall not be readjusted within the term of validity of
the tonnage licence already obtained even if the net weight of a vessel is
increased or reduced due to repairs. However, at the time of the next
payment of tonnage, an application shall be made for the adjustment of the
tonnage amount on the basis of the certificate of tonnage after its change
of weight. If the increase in weight is not disclosed and declared with
the intention of evading tonnage payment, the vessel shall be fined as
stipulated in Article 14 of these Measures.
Article 10
In any of the following cases for a vessel which has paid tonnage, the
Customs shall annotate and comment on the extension of the term of the
licence validity according to the actual number of days after examining
the papers submitted by the port authorities:
(1) a vessel sailing into a port in the country for asylum or repair;
(2) a vessel under quarantine and unable to embark or disembark passengers
or cargos;
(3) a vessel having been commandeered and chartered by the Central
Government or a local people's government.
Article 11
The following foreign registered vessels shall be exempt from tonnages:
(1) vessels for use by embassies, legations and consulates of countries
having diplomatic relations with China;
(2) vessels with papers from the local port authorities to take asylum,
undergo repairs, suspend service or be disassembled and not to embark or
disembark passengers or cargos;
(3) mooring pontoons, floating-bridge pontoons and floating boats used
exclusively for embarking or disembarking passengers or cargos and storing
goods;
(4) vessels commandeered or chartered by the Central Government or local
people's governments;
(5) international vessels which are exempt from making declarations at the
Customs for entry as stipulated in Article 27 of the Provisional Customs
Law. [*1]
Article 12
If a charter-party goes through Customs formalities before the vessel
arrives at the port, it shall submit a written guarantee to the Customs
house to assure submission upon entry of the vessel of the tonnage licence
for examination or payment of the tonnage and application for licence
according to regulations. The term of validity of the licence shall begin
on the date of the vessel's declaration for entry.
Article 13
If the tonnage licence obtained by a charter-party is defaced or lost
during the term of validity, it shall make a written application to the
original licence-issuing Customs establishment (or tax bureau) for a copy
of the tonnage licence. No further payment is required.
Article 14
All formalities shall be observed within the time limit set. A charter-
party who fails to make a declaration, pay the tonnage and obtain the
licence shall be fined not more than three times the payable tonnage
amount and the fine shall be paid into the treasury as Customs' fines.
Article 15
These Measures shall go into force as of the date of promulgation.
